Bausch & Lomb has won a round in its patent infringement fight against CIBA Vision over its own PureVision line of extended wear contact lenses. The European Patent Office in Munich has revoked a patent held by Novartis, parent company of CIBA Vision, claiming that it lacked novelty. CIBA Vision, which claimed that this patent had been infringed by B&L's PureVision lenses, says it will appeal the decision because of ?several legal and factual errors? and that it will prevail as it already did in the USA, forcing B&L to shift production to Ireland, where a similar case is still pending. For its part, B&L says it will immediately seek a new start for its sales of PureVision lenses in Germany, which it had stopped last April following a Düsseldorf court's decision in favor of Novartis.
