Bausch & Lomb is seeking the cancellation of an injunction by a German court in Düsseldorf earlier this year, which led it to stop sales of its PureVision contact lenses in the country, following a verdict by the European Patent Office in Munich which revokes a patent held by Novartis, parent company of CIBA Vision. The Munich-based body said that Novartis' patent, which covers its silicone hydrogel extended wear contact lenses, lacked novelty and followed an earlier patent obtained by B&L. The latter will also ask an Irish court to stay Novartis' patent proceedings against B&L in Ireland, where it continues to produce PureVision lenses. Novartis has the right to appeal the Munich verdict but the Swiss company and CIBA Vision have not issued a statement yet on the case.
