Following two years of court testimony that saw Aspex' vice president, Thierry Ifergan, and Revolution's president, Gary Zelman, both take the stand, a district court in California ruled last April 30 that Revolution Eyewear infringes on Aspex' patent related to its magnetic clip technology. The decision came after an initial lawsuit by Revolution against Aspex in 2002, in which Revolution sued the company for patent infringement. On March 31, 2005, Aspex obtained a dismissal of Revolution's claims and on the same day filed suit against Revolution for infringement on the same patent, a certain ?U.S. RE 37,545.? Aspex is still tied up in similar legal battles with Safilo, Viva International and Marchon Eyewear.
