The Amsterdam Court of Appeal ruled yesterday in favor of GrandVision in the lawsuit opposing the retail group to EssilorLuxottica, confirming the earlier judgement by the District Court in August last year. The Franco-Italian group claimed that GrandVision had been retaining information in relation to the management of its business in the context of the Covid-19 pandemic. In July 2020, the Dutch group had initiated arbitration proceedings against EssilorLuxottica’s accusation, seeking confirmation that it has not breached the support agreement in connection with the planned takeover. GrandVision confirmed yesterday that the arbitration proceedings were still ongoing, behind closed doors, and that they were independent from yesterday’s court ruling. The group also reiterated that it supports the planned acquisition by EssilorLuxottica with the shared objective of closing the transaction before next July 31. The Franco-Italian group had not commented on the decision of the Amsterdam Court of Appeal at the time of closing this issue.
